ஒரு வேண்டுகோள் (காவிரி சிக்கல்) =========================== தமிழகத்தின் ஜீவாதாரப் பிரச்சினையான காவிரி சிக்கல் ஒரு கேள்விக்குறியாகவே ஆகிவிட்டது. தமிழக உரிமைகள் யாவும், பறிக்கப்பட்டுவிட்டன. கர்நாடகம், தமிழகத்தினுடைய உரிமைகளையும், பலன்களையும் கபளீகரம் செய்தது மட்டுமல்லாமல் காவிரி நடுவர் மன்றத் தீர்ப்பையும், உச்சநீதிமன்றத் தீர்ப்பையும், ஒரு கூட்டாட்சியில் மதிக்காத மாநிலமாக ஒரு போக்கிரியைப் போல் தன்னை பறைசாற்றிக் கொள்கிறது. இதையும் மத்திய அரசு பார்த்துக்கொண்டு வாய்மூடி மௌனியாகவும் உள்ளது. ஒவ்வொருவரும் காவிரி குறித்து குரல் எழுப்பவேண்டிய நிலையில் நாம் இருக்கின்றோம். அக்கறை உள்ள தமிழகத்து சகோதர, சகோதரிகள் இத்தோடு இணைக்கப்பட்டுள்ள மனுவை, பிரதி எடுத்து, கையொப்பமிட்டு, குடியரசுத் தலைவருக்கு அனுப்ப ஒரு சிறு முயற்சியை மேற்கொள்ளலாம். மக்களின் சக்தியே மகேசன் சக்தி என்பார்கள். எனவே இந்தப் பணியை நாம் அனைவரும் அணிலாக இருந்து கடமையென பாவித்து செய்வோம். வாரீர்! குறிப்பு: இதை பிரதியெடுத்து, தங்கள் முகவரி, தேதி குறிப்பிட்டு, கையொப்பமிட்டு, அஞ்சல் தலை ஒட்டி இதய சுத்தியோடு அனுப்பினாலே, இயற்கையின் நீதி தமிழகத்துக்கு கிடைக்கும் என்ற நம்பிக்கை. அக்கறை உள்ளவர்கள் தயவு செய்து இந்தப் பணியை ஆற்ற அன்புடன் வேண்டுகிறேன். இதனை தங்களுடைய நண்பர்களுக்கும் பகிர வேண்டுகிறேன். His Excellency The President of India, Date : Rashtrapathi Bhavan, New Delhi Respected Sir, Vanakkam. I, wish to draw your kind attention to the growing anguish and dissent among the people of Tamil Nadu against the apathy and unwillingness to protect the interests of the farmers in Tamil Nadu, in due sharing of Cauvery Water. As our Hon’ble President is the constitutional authority of our country, it will be superfluous on our part to elaborate the constitutional provisions of water sharing. Cauvery water sharing dispute arose in 1974 between Tamil Nadu and Karnataka states. Tamil Nadu is the lower riparian state along with Kerala and the Union Territory of Puducherry. The dispute was raised on the basis of agreement between Madras Presidency and the Erstwhile Mysore State. The Government of India, during the tenure of Mr V.P. Singh as the Prime Minister, the Cauvery Water Disputes Tribunal (CWDT) was formed to adjudicate upon water dispute regarding inter-state river Cauvery on 2nd June 1990, as per the notification No. S.O. 437 (E) under Section 4 of Inter-State Water Dispute Act, 1956. The Tribunal after fourteen years of deliberation passed the final order on 5th February 2007 and directed the said order to union of India for necessary actions. Now, almost nine years over. No further fructified action from the Union of India has taken place to save the rights of riparian States of Cauvery, even after the said award was notified on 9th February 2013. The Tribunal award of clause 5 notified the sharing quantum of water to riparian states and also clause 7 of final order indicates about the water sharing during the distress years. The CWDT considered all issues raised during its enquiry and gave the final order. Even after the final verdict, both Union of India and State of Karnataka were adamant in following the CWDT final award. Now, the Union of India have the liability and responsibility to implement the final award of CWDT. As a federal nation, the Government of India is bound to protect the interests of the affected states. In Cauvery Water Dispute, the federal norms are not followed till date. Therefore, the Government of India is duty bound to ensure that the Supreme Court of India and CWDT orders are followed in toto. Section 6(A) Inter-state Water Dispute Act as amended in 2002 states: “the establishment of any authority (whether described as such or as a committee or other body) for the implementation of the decision or directions of the Tribunal.” Section 6 (A) 2 (a) states: “the establishment of any authority (Whether described as such or as a Committee or other body) for the implementation of the decision or directions of the Tribunal.” Therefore, the Government of India’s is duty bound to establish a statutory authority for the implementation and enforcement of the CWDT award is must. Section 6 (2) of the Interstate Water Dispute Act states that “The decision of the Tribunal, after if publications in the official Gazette by the Central Government under sub-section (1) shall have the same force as an order of Decree of the Supreme Court.” Article 262 (1) (2) of the Constitution of India, makes it obligatory to constitute a due authority to take control over water-sharing between the disputed states. Hence, the Government of India is to follow the above legal provisions. In India, so many water disputes are raised by different states namely 1. Sutlej-Yamuna Link Canal, 2. Mahanadi River, 3. Krishna River, 4. Godavari River etc. These issues were settled and there is amicable sharing of water between the states concerned. Similarly, Nile, Amazon, Yangtze River, Mississippi River , Missouri, Amu Darya, Congo, Lena etc. are flowing between different countries and the water is shared peacefully. In U.S., between North Carolina and South Carolina problems arose about water sharing and the matter was taken up by the Federal Court. Finally, both states settled the issue out of court. These are the few examples of water dispute elsewhere in the world. I want to bring your kind attention on the Accord of Helsinki Principles. It protects the rights of the riparian states in sharing of waters. This should be applicable to Cauvery water dispute also. Now, Tamil Nadu is almost dry without water. Cauvery delta farmers are unable to cultivate their lands. They are peacefully demonstrating for their rights in the Cauvery water as per orders of Supreme Court and CWDT. After the order of the Supreme Court and CWDT the situation is very grim. The farmers of Tamil Nadu are facing great hardships which are driving them to suicide. This is the real situation of Cauvery delta area. As per the order of the Tribunal, the Government of Karnataka should have released 123 tmc of water to Tamil Nadu. So far, as on 27/9/2016, the water released was only 52 tmc, which do not even conform to distress sharing formula ordered by the Tribunal. Under these circumstances, I request Your Excellency to intervene this matter, direct the Union of India to constitute Cauvery Water Management Board under the Inter-State Water Dispute Act of 1956 forthwith and provide justice and save the farmers.
