சென்னை உயர்நீதிமன்ற நீதிபதி விக்டோரியா கௌரி நியமனத்தை எதிர்த்து தாக்கல் செய்யப்பட்ட மனு, அவசர விசாரணையாக உச்ச நீதி மன்றத்தில் விசாரிக்கப்பட்டு வழக்கு தள்ளுபடி செய்யப்பட்டது. கம்யூனிஸ்ட் கட்சியைச் சேர்ந்த வைகை, அன்புக்குரிய நண்பர் அண்ணா மேத்யூ ஆகியோர் இந்த மனுவைத் தாக்கல் செய்தனர். 

அரசியல் கட்சியைச் சேர்ந்தவராக விக்டோரியா கௌரி இருந்தார் என்பதே இந்த மனு தாக்கல் செய்யப்பட்டதற்கான காரணம். 

இவ்வாறு அரசியல் கட்சியைச் சேர்ந்தவர்கள் உயர் நீதிமன்ற நீதிபதிகளாக நியமிக்கப்பட்டது பலமுறை விமர்சனத்துக்கு உள்ளாகியிருக்கிறது. 

1.ஓமந்தூரார் சென்னை ராஜதானியில் பிரீமியராக  (முதல்வர்) இருந்த காலத்தில் எங்கள் பகுதியைச் சேர்ந்த ஏ.அழகிரிசாமி அவருடைய ஆலோசகராக நியமிக்கப்பட்டது குறித்தான விமர்சனங்கள் எழுந்தன. அழகிரிசாமி  எனது  உறவினரும் கூட . நீதித்துறையைச் சேர்ந்த அவர் பின்னாள்களில் உச்ச நீதிமன்றம் வரை நீதிபதியாகப் பொறுப்பு வகித்தார்.  கோவில்பட்டி அருகே நாகம்பட்டியில் பிறந்தவர். இவர் சி.சுப்ரமணியத்தின் கல்லூரி கால வகுப்புத் தோழர். காங்கிரஸ் குடும்பத்தில் பிறந்தவர். காங்கிரஸ் அனுதாபி. நீதித்துறையில் இருந்த இவரை முதலமைச்சரின் ஆலோசகராக எப்படி நியமிக்கலாம் என்ற சர்ச்சை எழுந்தது. அதுதான் முதலாவது சர்ச்சை.

2.அண்ணா மறைவுக்குப் பின் கலைஞர் காலத்தில் நீதிபதி பி.ஆர்.கோகுலகிருஷ்ணன் சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டார். பின்னாட்களில் அவர் குஜராத் உயர்நீதிமன்றத்தின் தலைமை நீதிபதியாகவும் இருந்தார். 

3. நீதிபதி எஸ்.ரத்னவேல் பாண்டியன் ஒன்றுபட்ட நெல்லை மாவட்டத்தில் திமுகவின் மாவட்டச் செயலாளர். இவர் சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டபோது சர்ச்சைகளும் எழுந்தன. பின்னாட்களில் இவர் உச்சநீதிமன்றத்துக்கு நீதிபதியாகச் சென்றார். 

4. நீதிபதி எஸ்.மோகன் திமுக அனுதாபி. அவர் சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டதும் உண்டு. 

5. நீதிபதி வேணுகோபால், திராவிட கழகத்தைச் சார்ந்த அபிமானி. சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டார். 

6. சமீப நாட்களில் ராஜ இளங்கோ என்ற திமுக நிர்வாகி உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டதும் உண்டு. பின்னாட்களில் அவர் ஆந்திர மாநில உயர் நீதிமன்ற நீதிபதியாக பொறுப்பிலிருந்தார்.

7. நீதிபதி கற்பகவிநாயகம் அதிமுகவைச் சேர்ந்தவர். எம்ஜிஆருக்கு மிகவும் நெருங்கியவர். அவரும் சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டார். ஜார்கண்ட் உயர் நீதிமன்ற தலைமை நீதிபதியாகவும் இருந்தார்.

8. உச்சநீதிமன்றத்தின் தலைமை நீதிபதியாகப் பொறுப்பு வகித்த ப.சதாசிவம், அதிமுக அனுதாபி. அவரும் தொடக்கத்தில் சென்னை உயர்நீதிமன்ற நீதிபதியாக நியமிக்கப்பட்டார். கேரள ஆளுநராகவும் நியமிக்கப்பட்டார். 

இவை எல்லாம் கடந்த கால நிகழ்வுகள்.

Controversies in the Appointment of Madras High Court Judges. 

The Supreme Court on Tuesday dismissed an urgent petition challenging the appointment of L Victoria Gowri as an additional judge of the Madras High Court. Vaigai, a member of the Communist party, and Anna Mathew filed the petition on the grounds that Gowri as a member of a political party had made hate speeches against the religious minorities. 

   The appointment of members of political parties as judges of the High Court has come under criticism many times in the past.

    When Omandur Ramasamy was the premier of the Madras Presidency, there were criticisms about the appointment of A. Alagiriswamy from our region as his adviser. Alagiriswamy is also a relative of mine. A member of the judiciary, he later served as a judge up of the Supreme Court. He belonged to Nagampatti near Kovilpatti and was a college classmate of C. Subramaniam. Born in a Congress family he happened to be a Congress sympathiser. A controversy arose as to how he, who was in the judiciary, could be appointed as an advisor to the Chief Minister. That is the first controversy.

After then Chief Minister Annadurai's death, Justice PR Gokulakrishnan was appointed as a judge of the Madras High Court during Kalaignar’s tenure. Later, he served as the Chief Justice of the Gujarat High Court.

Justice S.Rathnavel Pandian was the district secretary of DMK in united Tirunelveli district. Controversies arose when he was appointed as a judge of the Madras High Court. Later he went to the Supreme Court as a judge.

Justice S. Mohan was a DMK sympathiser. He was also appointed as a judge of Madras High Court.  

Justice Venugopal, an admirer of Dravida Kazhagam, was appointed as a judge of the Madras High Court.

In recent years, Raja Ilango, an executive member of DMK,  has also been appointed as a High Court judge. He had served as a judge of the Andhra Pradesh High Court.

Justice Karpagavinayagam belonged to AIADMK and was very close to MGR. He was also appointed as a judge of the Madras High Court and later served as the Chief Justice of Jharkhand High Court. 

Justice P. Sathasivam, who served as the Chief Justice of the Supreme Court, was an AIADMK sympathiser. He was also initially appointed as a judge of the Madras High Court and became Chief Justice of India. After retirement he was appointed as the Governor of Kerala. Justice Chandru from CPM.

       These are all past events of political appointments of judges which were mired in controversies.
