வழக்கறிஞர் கே.எஸ். இராதாகிருஷ்ணன்
தமிழகத்தின் அரசியல் களத்தில் 49 ஆண்டுகளாககளப்பணியாற்றுபவர், வழக்கறிஞர், மனித உரிமைகள் மற்றும்சுற்றுச்சூழல் ஆர்வலர், எழுத்தாளர், நூல் ஆசிரியர், கதைசொல்லியின் இணை ஆசிரியர், சமூக வலைதளங்களில்செயல்படுபவர், தமிழகத்தின் அரசியல் கட்சிகளிலேயே முதல்முதலாக செய்தி தொடர்பாளராக 23 ஆண்டுகளுக்கு முன்புநியமிக்கப்பட்டவர், தேர்தல் களங்களை கண்டவர், பல்வேறுபோராட்டங்களில் கலந்துகொண்டு சிறைவாசமும் கண்டதும்உண்டு, தொலைக்காட்சி விவாதங்களில் பங்கேற்பவர் என பலஅடையாளங்கள் உண்டு. இப்படி பல தளங்களில் செயல்பட்டுவருபவர். கர்மவீரர் காமராஜர், திமுக தலைவர் டாக்டர். கலைஞர், ஈ.வி.கே. சம்பத், கவிஞர் கண்ணதாசன், பழ.நெடுமாறன், விவசாயிகளின் தலைவர் சி. நாராயணசாமிநாயுடு, திரு. வைகோ ஆகியவர்களின் நன்மதிப்பைப் பெற்றவர். 1989 மற்றும் 1996 ஆகிய ஆண்டுகளில் நடந்த தமிழகசட்டமன்றத் தேர்தலில் கோவில்பட்டி தொகுதியில்போட்டியிட்டார். இவரோடு விடுதலைப் புலிகள் இயக்கத்தின்தலைவர் பிரபாகரன் ஆரம்பக் கட்டத்தில் தங்கியிருந்து நட்புபாராட்டியவர். அப்போது வெளி உலகத்துக்கே தனது முகத்தைகாட்டாமல் தலைமறைவு வாழ்வில் இருந்தார் பிரபாகரன். எவ்வளவோ பணிகள், காலம் தந்த பாடங்கள் என கடந்த காலச்சக்கரங்கள் வேகமாக நகர்ந்துவிட்டன. சுடுமணலில்பயணமோ, தென்றல் பயணமோ என்று பாராமல் நிம்மதியானஅரசியல் பயணமாக உள்ளது. ஏற்ற இறக்கங்கள் எல்லாம்இதில் இயற்கையான நிலைப்பாடு ஆகும். எவ்வளவோ தமிழகஅரசியல் முக்கிய நிகழ்வுகள் கண் முன் நிகழ்ந்துள்ளன.
கே.எஸ்.ஆர் என்ற அழைக்கப்படும் இவர், திருநெல்வேலிமாவட்டம் குருஞ்சாக்குளம் கிராமத்தில் ஒரு விவசாயக்குடும்பத்தில் பிறந்தார். சட்டப் படிப்பில் தனது முதுநிலைக்கல்வியை முடித்தபின் 1981 ஆம் ஆண்டு முதல் தமிழ்நாடுவழக்கறிஞர் கழகத்தில் பதிவு செய்து கொண்டு, சென்னைஉயர்நீதி மன்றத்தின் பல்வேறு சிவில், கிரிமினல் மற்றும்பொதுநல வழக்குகளில் வழக்குரைஞராக வாதாடியுள்ளார்.
திரு. கே.எஸ். இராதாகிருஷ்ணன் அவர்கள் புது தில்லியில்இயங்கி வரும் இந்திய சட்ட நிறுவனத்திலும், சர்வதேச சட்டஅமைப்பின் (இந்தியா பிரிவு) மற்றும் இந்தியா மத்தியஸ்தகவுன்சில் ஆகியவற்றில் ஆயுட்கால உறுப்பினராக இருந்துவருகிறார்.
இந்திய வழக்கறிஞர்கள் சங்கத்தின் தமிழகப் பிரிவின் இணைச்செயலாளராக இருந்து வருகிறார். பல்வேறு அரசு அமைத்தவிசாரணை கமிஷன்களிலும் வழக்கறிஞராக ஆஜராகி உள்ளார்.
தமிழக அரசின் அறநிலையத் துறையின் சார்பாக பல்வேறுவழக்குகளில் வழக்கறிஞராகவும், தமிழ்நாடு நுகர்பொருள்வாணிபக் கழகம் மற்றும் தமிழ்நாடு தொழில் கழகத்தின் சட்டஆலோசகராகவும் இருந்து வந்தார்.
கொச்சி துறைமுக கழகத்தின் மத்தியஸ்த அமைப்பின்நடுவராக இருந்தார்.
மத்திய திரைப்படத் தணிக்கைத் துறையின் உறுப்பினராக 12 வருடங்கள் இருந்தார்.
மத்திய அரசின் ரயில்வே அமைச்சகத்தின் பயணிகளின் நலவாரியத்தின் உறுப்பினர், மத்திய சுற்றுச் சூழல் அமைச்சகத்தின்ஆலோசனைக் குழு உறுப்பினராகவும் பொறுப்பில் இருந்தார்.
மத்திய அரசின் தொழிலாளர் நல அமைச்சகத்தின் கீழ்அமைந்துள்ள குழந்தை தொழிலாளர் மற்றும் தொழிலாளர்கல்விக்கான மத்திய ஆலோசனை வாரியத்தின்உறுப்பினராகவும் இருந்தார்.
ஐ.நா. மன்றத்தில் நியூயார்க்கில் கிடைத்த பெரிய பொறுப்பைஉதறி அரசியல் பணியில் ஈடுபட்டுள்ளார்.
இவருடைய சகாக்கள் இன்றைக்கு உச்சநீதிமன்ற, உயர்நீதிமன்ற நீதிபதிகள். இவரால் அரசியலுக்கு வந்தவர்கள், இவரால் உயர்ந்தவர்கள் எல்லாம் இன்றைக்கு முன்னாள், இந்நாள் நாடாளுமன்ற உறுப்பினர்கள், அமைச்சர்கள்.
மக்களுக்கான நீதி சேவை:
- சென்னை உயர் நீதிமன்றத்திலும் உச்சநீதிமன்றத்திலும் மக்கள் நலனுக்காக பல்வேறு பொதுநல வழக்குகளை தொடர்ந்தவர். அதில் நாட்டில் உள்ளநதிகளை தேசியமயமாக்குதல், கங்கை-கிருஷ்ணா-காவிரி-வைகை-தாமிரபரணி-குமரி மாவட்டம்நெய்யாறோடு இணைத்தல், கேரளாவில் உள்ளஅச்சன்கோவில்-பம்பை தமிழகத்தில் உள்ளவைப்பாறோடு இணைத்து மற்றும் மேற்கே கேரளாவில்மேற்கு நோக்கி பாயும் நதிகளின் உபரி நீரைதமிழகத்திற்கு திருப்பி விடக் கோரி என்று 1983 ஆம்ஆண்டு முதல் போராடி உச்ச நீதிமன்றத்தில் போராடி27-02-2012ல் தீர்ப்பையும் பெற்றார். உச்சநீதிமன்றத்தில்சிறைக் கைதிகளுக்கான வாக்குரிமைக்காகவும்பஞ்சாயத்து ராஜ் அமைப்பில் மூன்றடுக்குமுறைக்காகவும் போராடினார். பல்வேறு ஊழலைஒழிக்க தேர்தலில் சீர்திருத்தங்களை கொண்டுவரவும், வாகன போக்குவரத்தை ஒழுங்குபடுத்தவும் பொதுநலவழக்குகளையும் தொடுத்துள்ளார்.
சென்னை உயர்நீதி மன்றத்தில் அவர் தொடர்ந்தகுறிப்பிடத்தக்க பொதுநல ரிட் மனுக்கள்:
- விவசாயிகள் மீது ஜப்தி நடவடிக்கைகள், அவர்களுக்குகடன் நிவாரண உரிமைகளைப் பெறவும் வழக்குகள்தொடுத்து உரிய ஆணைகளையும் உயர்நீதிமன்றத்தில்பெற்றார்.
- தூக்குத் தண்டனை கூடாது என்று இன்றைக்கு எட்டுதிக்கிலிருந்தும் குரல்கள் கேட்கின்றன. 1983 ல்உச்சநீதிமன்றம் நிராகரிக்கப்பட்டு, குடியரசுத்தலைவரிடம் வழங்கப்பட்ட கருணை மனுவும் தள்ளுபடிசெய்யப்பட்டு, இனிமேல் வேறு வழி இல்லை. தூக்குதண்டனைதான் என்ற நிலையில் 3 நாட்களில் தூக்கில்தொங்க இருந்த வீரபாண்டிய கட்டபொம்மனின் வாரிசுகுருசாமி நாயக்கரை, வெறும் மூன்று வரி தந்தியில்சென்னை உயர்நீதிமன்றத்தில் தூக்கு தண்டனையில்இருந்து காப்பாற்றியதெல்லாம் கடந்த காலம். இது ஒருஉயர்நீதிமன்ற வழக்கறிஞர் என்ற முறையில் செய்தகடமையாகும்.
- கம்பம் பள்ளத்தாக்கில் அமைந்துள்ள கண்ணகிகோவிலுக்கு தமிழ் நாட்டைச் சேர்ந்த பயணிகள்வருவதற்கு கேரள அரசு தடை விதித்தையடுத்து, சென்னை உயர் நீதிமன்றத்தில் வழக்கு தொடர்ந்துஅங்கு காவல்துறை பாதுகாப்புடன் பக்தர்கள்வழிபாட்டை தொடர வழி செய்தார்.
- விடுதலைப் புலிகள் இயக்கத் தலைவர் பிரபாகரனின்பாண்டி பஜார் துப்பாக்கிச் சூடு வழக்கு, ஏனையவழக்குகளிலும் வழக்கறிஞராக வாதிட்டவர்.
- ஈழத் தலைவர்கள் பாலசிங்கம், சந்திரஹாசன், டாக்டர்சத்யேந்திரா எம்.ஜி.ஆர். ஆட்சிக் காலத்தில்தமிழகத்திலிருந்து நாடு கடத்தியபோது வழக்குத்தொடுத்து 24 மணி நேரத்தில் இந்தியாவிற்கு திரும்பஅழைக்கப்பட்டனர். இந்த வழக்கை சிறப்பு அனுமதிபெற்று நடத்தினார்.
- 1983 ஆம் வருடம் விருதுநகர் மாவட்டம் ஆலங்குளத்தில்இயங்கி வந்த தமிழ்நாடு சிமெண்ட் ஆலையில் இருந்துவெளியேறிய நச்சுப் பொருட்களால் சுற்றுச்சூழல் மாசுஏற்பட்டு வந்ததையடுத்து அந்த ஆலையினை மூடவேண்டி தொடர்ந்த வழக்கில் ஆலையை மூடுமாறுஇடைக்கால உத்தரவு பிறப்பிக்கப்பட்டது. தமிழக அரசு70 கோடி ரூபாய் செலவில் அந்த ஆலையை புதுப்பித்துசுற்றுச்சுழல் மாசுபடாமல் இருக்க செய்யுமாறு உயர்நீதிமன்றம் அறிவுறுத்தியது. இந்த உத்தரவால்ராஜபாளையம் மற்றும் சிவகாசி பகுதி மகிழ்ச்சியடைந்துதிரு. கே.எஸ்.ஆர் அவர்களுக்கு தங்களது மனமார்ந்தநன்றியினை தெரிவித்துக் கொண்டனர்.
- 1983 இவர் தொடர்ந்த ரிட் மனுவினால் திருநெல்வேலிமற்றும் தூத்துக்குடி மாவட்டத்தை தமிழக அரசு வறட்சிபாதிக்கபட்ட பகுதியாக அறிவித்தது
- காவல் நிலையத்தில் இறந்த பலரது குடும்பங்களுக்குபொதுநல வழக்கு தொடர்ந்து அதன் மூலம் இழப்பீட்டுதொகையை பெற்றுத் தந்துள்ளார்.
- விவசாய மற்றும் சுற்றுச்சூழல் தொடர்பாக இவர்தொடர்ந்த ரிட் மனுக்கள் பல நிலுவையில் உள்ளன.
- காவிரி பிரச்சினையிலும், முல்லைப்பெரியாறிலும்எடுத்துக்கொண்ட வழக்குமன்ற நடவடிக்கைகள்.
- சென்னை உயர்நீதிமன்றத்தில் 1999ல் சட்ட மேலவைஅமைக்க மத்திய அரசு நடவடிக்கை எடுக்க வேண்டும்என்று உத்தரவு பெற்றார்.
- தேசிய மனித உரிமை ஆணையத்திலும், மாநில மனிதஉரிமை ஆணையத்திலும் பல்வேறு வழக்குகள் தாக்கல்செய்துள்ளார். சந்தனக் கடத்தல் வீரப்பன் வழக்கில்அப்பாவி மக்கள் கர்நாடக அரசால் மைசூர் சிறையில்வாடியவர்களுக்கெல்லாம் குரல் கொடுத்தார்.
- கூடங்குளம் அணுமின் நிலையத்திற்கு எதிராக முதல்முதலில் வழக்கு தொடர்ந்தார்.
15.மேற்கு தொடர்ச்சி மலை, கிழக்கு தொடர்ச்சி மலைபோன்றவற்றின் வளங்களை பாதுகாக்க வழக்கு

இவருடைய சீனியர் முதுநிலை வழக்கறிஞர் ஆர். காந்தி, மறைந்த பிரபல முதுநிலை வழக்கறிஞர் என்.டி. வானமாமலைஆகியோர் இவரை வழி நடத்தினர். வழக்குகளில் இவருக்குவழிகாட்டினர்.
மனித உரிமை மற்றும் சுற்றுச்சூழல் தொடர்பானபிரச்சினைகள்:
அம்னெஸ்டி போன்ற மனித உரிமை மீறலுக்காக போராடி வரும்உலகளாவிய மனித உரிமை அமைப்புகள் பலவற்றுடன்இணைந்து மனித உரிமை, குழந்தை தொழிலாளர் ஒழிப்பு, பாலியல் தொழில் ஒழிப்பு மற்றும் பல்வேறு சமூகப்பிரச்சினைகளுக்கான தளங்களில் ஆய்வுகளை மேற்கொண்டுவருகிறார். தமிழகத்தில் விவசாயப் போராட்டம் வலுவாகஅரசை எதிர்த்து நடந்தபொழுது அதில் பங்கேற்றவர். இவர்சொந்த கிராமத்தில் காவல்துறையினரி துப்பாக்கிச் சூட்டிற்கு 8 விவசாயிகள் பலியானார்கள். அந்த வழக்கையும் சென்னைஉயர்நீதிமன்றம் வரை நடத்தி விவசாயிகளுக்கு விடுதலையும்பெற்றுத் தந்தார்.
மரண தண்டனைக்கு எதிராக பல்வேறு வழக்குகளில்தண்டிக்கப்பட்ட சிறைக்கைதிகளுக்கு ஆதரவாகவாதாடியுள்ளார். ஊடகத்தில் மனித உரிமை குறித்துதொடர்ந்து எழுதிவருவது மட்டுமல்லாமல் பலபுத்தகங்களையும் வெளியிட்டுள்ளார். மேற்குத் தொடர்ச்சிமலையில் ஏற்படும் சுற்றுச் சூழல் பாதிப்பு குறித்து பலவிதமானஆய்வுகளை மேற்கொண்டு வருகிறார்.

K.S.Radhakrishnan – The Profile
K S Radhakrishnan is a Political Analyst, Legal Expert, Human Rights and Environmental Activist, Writer and Columnist hailing from Tamil Nadu. He has been actively involved in Tamil Nadu politics for more than 45 years.
Twenty-five years ago, he was elected as the first Spokesperson of a Regional Political Party in Tamil Nadu. He has worked closely with great leaders like Kamarajar, Kalaignar M. Karunanidhi, EVK. Sampath, Poet Kannadasan, Pazha Nedumaran , Farm Folk Leader C Narayanswamy Naidu, Karnataka Former Chief Minister Devaraj Urs, Srilankan TULF Leader A. Amirthalingam, Vaiko and others .
He also participated in Tamil Nadu Legislative Assembly Elections in the year 1989 and 1996 in Kovilpatti.
LTTE Leader Prabakaran, in his early days, stayed along with him and have huge respect for him.
Fondly called as KSR, he was born on December 31, 1956, in an agricultural family in Kurunjakulam village, Tirunelveli District, Tamil Nadu. After completing his post graduation and a degree in Law, he got himself enrolled as an Advocate with the Bar Council of Tamil Nadu in 1981 and started practising writ in the original side and appellate side of civil and criminal jurisdiction of the High Court of Judicature, Madras and arbitration as well.
Milestones
He is a Life Member of Indian Law Institute – New Delhi, Member of International Law Association (India Chapter) and Indian Council of Arbitration. He is the Joint Secretary of Indian Lawyer’s Association (Tamil Nadu Chapter). He has held various positions in the Public and Government sectors. In the past, he had provided his services as an Advocate representing the State for the HR&CE, Government of Tamil Nadu and was a Legal Advisor for Tamil Nadu Civil Supplies Corporation and Tamil Nadu Industrial Corporation.
He served as an Arbitrator for Cochin Port Trust, Govt. of India. He was a former member of Central Board of Film Certification (under Ministry of Information and Broadcasting, Government of India). He held the position of Committee Member at CBFC for three consecutive terms spanning 12 years.
As a member of many organizations, he has extended his services to satisfaction for all stakeholders. He was a member of Central Advisory Board on Child Labor and Worker’s Education Board (both under Ministry of Labor) and ZRUCC and SRUCC (under Ministry of Railways).
He is a Life Member of Alliance Françoise De Madras and Common Cause (Public Interest Litigation Forum).
Practising the Law for the People
He is recognised and appreciated for his eminence in legal activism. He has filed Public Interest Litigations (PIL) in the Supreme Court of India and in the High Court of Madras for common causes. Some of the best-known petitions were the ones that seek Nationalization of Rivers, Linking of National Rivers and diverting the west-flowing rivers from Kerala to Tamilnadu (originating from the Western Ghats) since 1983. Elaborate very broad electoral reforms PIL on the file of the Supreme Court of India. He had also fought for voting rights for Prisoners and 3-tier system for Panchayat Raj in the Supreme Court of India.
In the High Court of Judicature at Madras, he has filed some significant writs.
- In 1983, his writ petition to arrest pollution and undertake remedial actions to prevent industrial hazardous materials emitted by Tamilnadu Cements in Alankulam, Virudunagar district was successful enough to make an interim order possible and consequently the plant was closed down till rectification. The High Court had directed the Government of Tamil Nadu to sanction over 70 crores INR to modernize the plant and implement environment-friendly measures. His timely intervention was a lifesaver for the farmers of Rajapalayam and Sivakasi areas.
- As the State Government of Kerala made impediments to the devotees of Kannagi Temple in the Cumbum Valley, he persuaded for the police protection to the worshippers from Tamil Nadu and restored the People’s right to worship in the High Court of Madras.
- In 1983, his writ made the Government to declare the districts of Tirunelveli and Tuticorin as drought-hit districts due to monsoon failures.
- He filed many PILs on the cases related to custodial deaths and secured compensation for the victims.
- His writs on agricultural and environmental issues are still pending for the Court to intervene.
- He had filed writs with National Human Rights Commission-New Delhi and State Human Rights Commission-Chennai on various compelling issues.
- He was the first writ petitioner for the Koodankulam issue.
- Also filed PIL for the preservation of Western Ghats and Eastern Ghats in Madra High Court and also subsequently National Green Tribunal, New Delhi.
He has appeared as Counsel to many inquiry commissions appointed by the State government and for many Public Interest Litigations. As a Political Activist, he has seen the inner walls of the prisons quite often.
Human Rights and Environmental Issues
Actively associated with international organizations like Amnesty International, National and Regional Agencies of Human Rights and Democracy, he has undertaken various studies and research on the status of civil liberties, child labour, prostitution and other social issues. He is a warrior against the death penalty and appeared as a counsel for the convicts. He writes extensively on Human Rights in the media and published several books on this subject. His extensive study about environmental issues in the Western Ghats is commendable.
Writing
He is a writer and litterateur and a notable personality in the media and publishing circles. He is the joint editor of Kathai Solli – a folklore magazine along with Thiru Ki. Rajanarayan (Veteran Tamil Writer) and an avid reader of Modern Tamil Literature.
