••• To people who don’t want jargon on “Vijay-Governor issue”: 1. TVK has 108 seats. 2. Majority needed to form govt is 118. 3. Even with Congress coalition, they are still short 4. Senior ex AIADMK, now TVK leader Sengottaiyan, advised TVK to go to the Governor as the “single largest party.” 5. In that case, Governor could have invited them first & then asked them to prove majority later on the floor. 6. But instead, TVK went with a coalition claim including Congress MLAs. 7. Now, the moment you officially claim coalition support, the constitutional kicks in of proof. 8. That is why Governor reportedly asked for proof of majority support under Article 164. 9. So technically, TVK did NOT go as a single largest party the way followers are portraying it. Why ignore the advice of a 9-time MLA & instead follow one day old Congress advisors ? They just learnt “Bommai vs Union of India” yesterday & started spamming. > Bommai case was about dismissing an already existing elected govt in KA. He was already CM, & Governor claimed he lost majority. Instead of conducting floor test, Congress govt at Centre imposed President’s Rule under Article 356. > That’s when SC said: “No, you cannot arbitrarily dismiss an existing govt without testing majority on Assembly floor.” > Here Vijay’s case is about formation of a completely new govt after elections. >Even if SC intervenes, TVK will still have to prove 118 on the floor. If numbers aren’t there, it’ll collapse like Vajpayee 1996 or Yediyurappa 2018.. & that’s exactly what Governor is avoiding. Also what happened during 2006 DMK regime… > And the funny part is, by the time SC gave the judgment in 1994, Bommai himself never came back as CM & it is just a win on paper #ksrpost #tamilnaduassembly #art356
