#ஐநா_மனித_உரிமை_ஆணையத்தில் (#UNHRC)ஈழத்தமிழர் குறித்தான என்னுடைய மனு தாக்கல் செய்யப்பட்டுள்ளது.

ஐ.நா. மனித உரிமை ஆணையம் 42வது கூட்டத்தொடர் கடந்த செப்டம்பர் 9ஆம் தேதி தொடங்கி கடந்த 27ஆம் தேதி முடிவடைந்தது. இந்த கூட்டத்தொடரில் கலந்து கொள்வதற்காக செல்ல இயலவில்லை. ஆனால், ஜெனீவாவில் உள்ள ஐ.நா. மனித உரிமை ஆணையத்தில் ஈழத்தமிழர் குறித்தான என்னுடைய மனு தாக்கல் செய்யப்பட்டுள்ளது. அந்த மனுவில் குறிப்பிட்ட விடயங்கள் வருமாறு, 

1. இன அழிப்பை செய்த ராஜபக்சேவை சர்வதேச மன்றத்தில் நிறுத்தி தண்டிக்கப்பட வேண்டும். கடந்த காலங்களில் லைபீரியா அதிபர் சார்லஸ் டெயிலரை இனஅழிப்பு குற்றத்திற்க்காக தண்டிக்கப்பட்டு லண்டன் சிறையில் அடைக்கப்பட்டார்.

மேலும், செர்பிய குடியரசுத் தலைவராக இருந்த மிலோசேவிக், அப்பாவி மக்களைக் கொன்று குவித்தார். இதற்காக 2006ஆம் ஆண்டு அவர் சர்வதேச நீதிமன்றத்தில் நிறுத்தப்பட்டு நான்கு ஆண்டு காலமாக விசாரணை நடைபெற்று வந்தவேளையில், அவர் சிறையிலேயே இறந்தார். சூடான் அதிபரான ஓமர் அல் பஷீர் கைது செய்யப்பட்டு, அவர் மீது சர்வதேச நீதிமன்ற விசாரணை நடைபெற்று வருகிறது. இப்படி நிறைய உதாரணங்களைச் சொல்ல முடியும்.

முதலில் ராஜபக்சே மீது சர்வதேச சுதந்திரமான புலனாய்வு செய்து அவரை பன்னாட்டு நீதிமன்ற பொறிமுறையில் சுதந்திரமான, நம்பகமான விசாரனை நடத்தி தண்டிக்கப்பட வேண்டும்.

அந்த விசாரனையில் ஈழத்தில் இன அழிப்பு நடந்தது என்று நிரூபிக்கப்படும். அந்த சூழலில் தான் தனிவாழ்வு என்ற தந்தை செல்வாவின் வட்டுக்கோட்டை தீர்மானத்திற்கு மேலும் சர்வதேச அளவில் வலு சேர்க்கும்.

2. சர்வதேச கண்காணிப்பில் ஈழத்தமிழர் விரும்பும் தீர்வான தனி வாழ்வா, சக வாழ்வா, தனி நாடா, சுயநிர்ணய உரிமை, ஒரு நாடு இருதேசங்கள் என்ற பிரச்சனைகள் குறித்து பொது வாக்கெடுப்பு நடத்த வேண்டும்.

இது நடைமுறைக்கு வரவேண்டுமெனில் சர்வதேச அளவில் ஆதரவு தேவை. மேற்குறிப்பிட்ட ராஜபக்சே மீது விசாரனை நடத்தி இனஅழிப்பு ஈழத்தில் நடந்தது என்று நிரூபிக்கப்பட்டால் இந்த பொது வாக்கெடுப்பு நடத்துவது மிகவும் எளிதாகிவிடும். இது தான் அடிப்படையாக செய்ய வேண்டிய பணிகள்.

3. வடக்கு, கிழக்கு மாகாணங்களில் உள்ள தமிழர்களை பீதியில் ஆழ்த்தும் சிங்கள ராணுவத்தை உடனடியாக திரும்ப பெற வேண்டும்.

4. இறுதிப் போர் 2009 ல் நடந்தபோது கைது செய்யப்பட்டவர்கள், காணாமல் போனவர்களை உடனடியாக விடுவித்து அவருடைய உறவினர்களிடம் அவர்களை சேர்க்க வேண்டும்.

5. தமிழர்களுடைய விவசாய நிலங்களையும், வீடுகளையும் சிங்களர்கள் கபளீகரம் செய்துவிட்டனர். அதை முறையாக தமிழர்களிடம் திரும்பி ஒப்படைக்க வேண்டும்.

6. ஒப்புக்காக ஏமாற்றும் அதிகாரமற்ற மாகாண கவுன்சில்களுக்கு நில நிர்வாகம், நில வருவாய், காவல் துறை, மீன்பிடி நிர்வாகம் என முக்கிய் அதிகாரங்களை வழங்காமல் இருப்பது தமிழர்களை வஞ்சிக்கின்ற நடவடிக்கையாகும். மாகாண கவுன்சில் என்பது ஏற்புடைய வாதமில்லை என்றாலும் நிர்வாகம் என்று ஒப்புக்கு ஏற்றுக்கொண்ட வகையில் இதன் உரிமைகளை பெற வேண்டிய கட்டாயத்தில் ஈழத்தமிழர்கள் உள்ளனர்.

இப்படியான அடிப்படையான விடயங்களை கவனம் செலுத்துவது முக்கியமான கடமை. இது அவசரமும் அவசியமும் ஆகும். சொல்ல வேண்டிய அவசியத்தினால் இதை வலியுறுத்துகிறேன். ஆக்கப்பூர்வமான எண்ணங்களம் நடவடிக்கைகளும் தான் இன்றைக்கு ஈழப்பிரச்சனைகளுக்கான தீர்வை வழங்கும்.

                An Appeal

I, K.S.Radhakrishnan, we call on the UNHRC to urge the Sri Lankan government to fully implement human rights for all citizens of Sri Lanka, and a political solution involving the full participation of the Tamil population, ending the systematic historical discriminatory measures of the Sri Lankan state against the Tamil people.

The Sri Lankan government has conducted a systematic genocide in which more than 1,00,000 Sri Lankan Tamils have been killed. Tamils who have been fighting for their rights are being brutally oppressed by the Sri Lankan government. 

Our party, has been fighting for the rights of the Sri Lankan Tamils for the past 30 years. The Genocide of Sri Lankan Tamils is not something that happened only in 2008-2009 timeframe. The agitation led by our party is itself evidence that the genocide has been happening for a long time. 

Under these circumstances, it is just a necessary to settle the following issues, 

The Sri Lankan Government announced the end of Civil war in 2009. It has been ten years since then. But even today Tamils are fighting for their rights. A structural genocide is happening to the Tamils in Sri Lanka. Every Sri Lankan Tamilian Faces one or other forms of oppression like enforced disappearances, Land grabbing, political imprisonment, living under heavy military surveillance.

The mothers of the Tamils who disappeared during the war have been protesting for close to 1000 days. Even after the end of war, there is a huge presence of Sri Lankan Army on the Tamil Land. 

 

The people have been protesting against these. They are frisked every day in the Military outposts. How can Sri Lankan Tamils live with freedom under such military occupation?

Every arm of the Sri Lankan government, The Army, the Forest Department, the Wild Life Department, the Housing Authority, the Mahaweli Authority, the Archaeological Department have been keen in grabbing Tamil Lands and wiping out the Tamil cultural symbols. The recent protests by the Tamils reveal this trend. The “Ezhuga Tamil” rally in the North and eastern provinces demanded that only International investigation will bring them justice.

There is no difference between the past Rajapaksa government and the current Mithiripal Sirisena government. Giving more time to the Sri Lankan government will only worsen the conditions of the Sri Lankan Tamils and put them in more danger.

The northern provincial council has also passed a resolution that only an international investigation can bring justice to the Sri Lankan Tamils.

I appeal to the Unite Nations Human Rights council to accept the demands of the Tamils and initiate an Independent International investigation on the Sri Lankan Government for the genocide.

The Sri Lankan Army should be withdrawn from the Tamil Homeland. I also request the Indian government at this juncture to respect the voice of 80 Million Tamils to initiate proceedings in the International Criminal Court against the Sri Lankan government for its crimes of Genocide.

 

1. Since the year 1948, ‘Ceylon’ as it was then known gained independence from Britain, Eelam Tamils are under oppression by the successive Sinhala majority governments.

2. From 1956 June Sri Lanka has massacred  Tamils from 1958,1977,

3. In 1983 Black July pogrom more than 3000 Tamils were burnt alive, 

4. In 1985 Valvai massacre was perpetrated

5. In1990-Eastern University massacre took place

6. In,2006-Trincomalee students massacre forming part of historical genocide culminated in the 2009 Mullivaikkal genocide in Vanni, 

7. Sri Lanka Armed Forces have perpetrated genocide against Eelam Tamils in which 146,679 Tamils are still unaccounted. 

8. State Armed Forces occupying the Tamil homeland(North-East provinces) oppressing the Tamils should be withdrawn.

9. Currently there is one member of the Armed Forces for every six civilians in the north. This is a threat to female headed families and orphaned girls. 

10. The armed forces have encroached economic activities of the Tamil peoples via controlling Fishing Industry and indulging in Farming, Tourism (running Holiday resorts, Hotels and Restaurants. This affects the livelihood of the civilians.  

11. Those Tamil youths who were arrested during the civil war period mainly on the basis of confessions obtained through torture and indicted under the two draconian laws, Prevention of Terrorism Act (PTA) and Emergency Regulations (EMR) are still in prisons, they should be released under general amnesty. 

12. Those who were arrested and those who surrendered during the last days of the war at Mullivaikkal should be released immediately.

 

13. Out of a total land area of 18,800 sq.kms. Inhabited by Tamil peoples in the North-East, Armed Forces are occupying 7000 sq.kms. 

14. Further thousands of grazing lands for the cattle of Tamils in Eastern Province have been vested in the Forest department by the President under whose purview the above subject come and Sinhalese from the South are settled there aided and abetted by the Government Special Task Force(STF). 

15. We seek a reliable independent inquiry by International Judges assisted by Legal experts.

16. Further as per the wishes of the Tamils under the supervision of the United Nation a referendum should be held among Eelam Tamils, Diaspora Tamils and Eelam refugees in India who were forcibly displaced from their homeland based on the right to self-determination inherent to every nation.

A special rapporteur should be appointed to monitor the Sri Lankan government in this regard and thus render justice.
