தேர்தல் சீர்திருத்தம், பெருகி வரும் வாகனங்களால் போக்குவரத்து நெரிசல்கள், அதனால் ஏற்படும் தாங்கமுடியாத சப்தங்கள் மற்றும் சுற்றுச் சூழல் பாதிப்புகள் குறித்து உரிய நடவடிக்கைகள் எடுக்க வேண்டுமென்று தலைமைத் தேர்தல் ஆணையருக்கும் மத்திய அரசுக்கும் கடந்த 2003 ஜனவரியிலிருந்து முறையாக விரிவான கடிதங்கள் எழுதியிருந்தேன். திரும்பவும் 20-07-2015 அன்று எழுதிய விரிவான கடிதங்கள் இந்தப் பதிவில் இணைக்கப் பட்டுள்ளது.
இந்திய தலைமைத் தேர்தல் ஆணையருக்கு எழுதிய கடிதத்தில்,
1990ம் ஆண்டு கோஸ்வாமி குழு அளித்த பரிந்துரைகளான தபால் நிலையங்களில் வாக்களர்கள் குறித்த குறிப்புகளையும், தேர்தலில் தவறு செய்பவர்கள் மீது கடுமையான குற்றவியல் சட்டங்கள் பாய்வதும், 1998ல் இந்திரஜித் குப்தா குழுவின் பரிந்துரையின்படி வேட்பாளர்களின் தேர்தல் செலவுகளை அரசே ஏற்றுக் கொள்ளவேண்டும் எனவும், இதுவரை மத்திய அரசால் அமைக்கப்பட்ட பத்துக்கும் மேலான குழுக்களின் பரிந்துரைகள் கிடப்பில் உள்ளன. அவைகள் நடைமுறைப்படுத்த வேண்டும், விகிதாச்சார பிரதிநிதித்துவ முறையின் சாத்தியக்கூறுகளை அறிய வேண்டும். தேர்தல்களில் கருப்புப்பணம் நுழைவது தடுக்க வேண்டும். சிறைக்கைதிகளுக்கும் வாக்களிக்கும் உரிமை வழங்க வேண்டும் என்ற பல்வேறு கோரிக்கைகளோடு என்னுடைய மனு முறைப்படி அனுப்பப்பட்டுள்ளது.
அதைப் போல மத்திய அரசின் தரைவழிப் போக்குவரத்து செயலாளருக்கு, போக்குவரத்து நெரிசல்கள் நாளுக்கு நாள் பெருக்குத் தொடர் முறையில் (Geometric ratio) பெருகி வருகிறது. சென்னை மாநகரில் மட்டும் இரண்டு மற்றும் நான்குச் சக்கர வாகனங்கள் ஒரு நாளைக்கு ஆயிரக்கணக்கில் பதிவாகிறது.
ஒரு வீட்டுக்குக் குறைந்தபட்சம் இரண்டு கார்களில் இருந்து ஐந்து கார்கள் வரை இருக்கின்றது. அவை நிற்க இடமில்லாமல் தெருக்களில் நிறுத்தி வைக்கப்படுகிறது, இதனால் ஏற்படுகின்ற தொல்லைகள் ஏராளம். வாகனப் புகையினால் ஏற்படும் சுற்றுச் சூழல்சீர்கேட்டினால் ஓசோன் படலமே மாசுபடும் என்ற அச்சத்தைத் தொடர்ந்து சொல்லி வந்தாலும் அதைக் குறித்தான அக்கறை யாருக்கும் வரவில்லை.
இப்படியான பிரச்சனைகளில் தேர்தல் நேர்மையாக நடக்க
தேர்தல் முறையில் தகுந்த சீர்திருத்தங்கள், போக்குவரத்து நெரிசலால் ஏற்படும் பெரும் துயர்களைப் போக்க வேண்டும் என்று மனுக்கள் கொடுத்தாலும் அதை அரசு ஏற்குமா ஏற்காதா என்று தெரியவில்லை.
ஏனென்றால் நான் நாடாளுமன்ற உறுப்பினரோ சட்டமன்ற உறுப்பினரோ இல்லை. ஒரு சாமானியன் முதலில் முறையாக இவர்களிடம் முறையிட்டு விட்டுதான் உச்சநீதிமன்றம் செல்லமுடியும். தகுதியே தடையாக இருப்பதினால் எங்களைப் போன்றவர்களெல்லாம் எம்.பியோ, எம்.எல்.ஏவோ ஆக முடியாத நிலைமை. எம்.பியும் எம்.எல்.ஏவும் ஆனவர்கள் சுகமாக அப்பதவியை அனுபவிக்கின்றார்கள்.
உச்சநீதிமன்றத்தில் நான் தொடுத்த சில வழக்குகளில் நியாயமான தீர்ப்புகள் கிடைத்த தைரியத்தின் காரணமாக, தேர்தல் சீர்திருத்தத்தைக் குறித்தும், போக்குவரத்து நெரிசலைப் பற்றியும் நாளை (23-07-2015) மறுநாள் டெல்லி சென்று உரிய பொதுநல வழக்கை தாக்கல் செய்ய உள்ளேன்.
அதற்கு அடிப்படையாக முறையான இந்த மனுக்களைச் சம்பந்தப்பட்ட துறைகளுக்கு அனுப்பி வைக்க வேண்டும். அந்தவகையில் இங்கே இணைக்கப்பட்டுள்ள கடிதங்கள் முறையாக அனுப்பி வைக்கப்பட்டுள்ளது.
மறைந்த கே. பாலச்சந்தரின், “தண்ணீர் தண்ணீர்” படத்தில் கோவில்பட்டி தாலுகா அலுவலகத்தில் கொடுக்கப்பட்ட மனு குப்பைக்கூடைக்குச் செல்வது போல, டெல்லிக்கு அனுப்பப்பட்ட மனுக்கள் யாவும் அந்தந்த பவனில் கோப்புகள் கட்டி கிடப்பில் போட்டுவிடப்படும். அதனால் எந்தப்பயனும் கிட்டாது.
உச்சநீதிமன்றம் மனுவை விசாரித்து முறையான தாக்கீது அனுப்பியபிறகு, அதிகார வர்க்கம் தூக்கத்திலிருந்து எழுந்து கோப்பில் கட்டி கிடப்பில் போடப்பட்ட மனுவை அப்போது தான் எடுத்துப் படிப்பார்கள். இதுதான் இந்திய ஜனநாயகத்தின் நிர்வாகப் பரிபாலனம்.
இதை நிறைவேற்ற வேண்டுமென்றால் ஒரே இடம் உச்சநீதிமன்றம் தவிர்த்து வேறு வழிவகைகள் இல்லை.

1. Details about criminal record of
nominated candidate with regard to the present status about ‘conviction’ of any criminal Act /
Whether pending or in FIR stage or any conviction on any criminal offense till
that day.
2. Academic Qualifications.
My
suggestions would be :-
1.
With regard to economical status details of Bank
Deposit and details of Bank Deposit of wife / Son are sought (there will not be
any purpose served) No purpose is solved.
Instead of all these
details, Question may be asked about the Intentions of candidate in joining
Politics and about Economical property / status (in my case in 1972) at the
time of joining Politics with full details about the party, year and date of
joining that party and about the properties / Economy values at that time and
also the value on that properties as on today with due documents, in order to
know about the Qualitative attitude.
2.
It is peculiar / ridiculous to read about the
Rule that while a Jail convicted is allowed to stand in Election by the
Electoral Body as an Electoral candidate when no voting right for that fellows
are allowed to be franchised. Why not the voting right be given also and this
fact may be considered.
3.
Proportionate Representation P.R.System – to be
debated.
4.
Why proposal / Amendment should not be made with
regard to Distributions of Equal Funds to be released from State Funds by the respective
states, following countries like Australia and European countries and the need
of hour is to implement Indrajits Gupta Report made in 1999-2000.
5.
Electoral process / Election Office / Body
should not encourage caste basis election i.e. nominating only that caste in
that area on the basis of prevailing majority caste. Instead Electoral office
should take a weapon of whip in its Hand to maintain / change India into
secular and caste less society in order to enable it to lead in Healthy
Development of prosperous future in our country. Suitable Reforms should be
passed / made through Constitutional Amendment on seats on Quota / Caste basis
to bring India a caste less society with Secular State, leading Indian to a
Healthy Developed Country.

Sub: Suggestions to pass and enact suitable
Legislation in Parliament
to prevent Pollution and
Congestion due to Present Transport Blocking.
I hereby bring your kind Notice to the
following suggestions, facts for your perusal and considerations, to frame
suitable Rules and Regulations, to prevent Pollution and Congestion due to
present Transport Blocking, by passing and enacting necessary Legislation in
the Parliament.
It is an undisputed fact that nearing
fifty percentage of Village people (rural Population) in Tamil Nadu have been
migrated and settled in Chennai and the Migration continues day by day
increasingly. As per 2010 census report the Chennai Population reached more
than 90 lakhs which is of more than that of Total Population of people in
countries namely: Sweden, Singapore, Norway, Denmark, Israel, Kuwait, New
Zealand, Switzerland, United Arab Emirates.
It is found that Madras Transport Road
consists of 303 km length consisting of Corporation Road, now on increase
having Chennai became Greater Chennai. The land and streets laid and situated
totally measuring in 2475 kilo meter approximately.
In Delhi there are more than 1 Crore
vehicles excitingly playing while in Mumbai 25 lakhs vehicles are on Road. The
data of 2010 year shows that Chennai register 700 new cars daily. It is also to
be noted that there are more than 3 lakhs vehicles approximately now excitingly
playing on Road. During British period people were riding on Horses using Roads
and maintained the speed of 20 km per hour. In 2009 in Chennai, it was found
that nearing 50 lakhs of vehicles with environmental connection including 2
wheelers, 3 wheelers, and four wheelers plying on Roads.
But, today, when compared to the
number of plying Vehicles, Roads have neither been established nor been
maintained or been laid down in a proper manner to meet the need of it today and
roads get damaged and patches formed in between Roads due to rain or by any
repairs by work man who lay down E.B. Cables / Network/ Cables/ Water Pipes and
when repair work on drainage carried on, they leave as it is without patching
up aptly. As such Road workers do not follow Rules and Regulations while laying
Roads, Repairing Roads, and large Holes left open causes threatening pavement
walkers and manhole opening causes threatening to vehicles. Vehicles plying
through Big Patches with deep pitches on Road causes vibration to adjacent
Buildings near by Roads long run damaged Roads also causes damages to tyres
ultimately causing economic loss to Nation.
It is also to be noted some people as
an ego drive four wheelers in rash and negligent manner as if plying in race
and Bike riders in silent night hours, put off silencer and increases too much
of horrible sound which causes panic, deafening ears, brings Heart problem at
midnight. From Traffic Jams and Pollution from Vehicle emission to lack of
signage and lighting, residents face slew of issues which are becoming
increasingly difficult to live in the locality. Residents land to inhale a lot
of vehicle emission. Traffic problem seems to have become almost persistent
with no action from the authorities concerned in regulating traffic, and motorists
are often stranded, delayed, confused, and scared to cross the dangerous
intersection in IT Park Roads. Employees as well as large number of communities traveling to and from the same areas are effected. Improper maintenance of
storm water drain/ man holes/ large hole/ encroachments of roads also are hurdle
for a smooth flow of vehicles.
More over residents residing in
congested areas and living in Flats and Houses situated in colonies and small
streets are in practice of parking their vehicles in streets and on road in
front of their houses and even on Main Roads the shop and business people
without strictly following rules and regulations park their vehicles in a zigzag way thereby causing inconvenience to the Road users. It is common among
people on pretext of maintaining false status, Who began to own (Cars &
Bikes) vehicles nearing 2 to 5 in number of each member a vehicle in each
family and due to these increase of vehicles, scarcity of space in parking
these vehicles arises accordingly.
Under such circumstances Chennai city
will be stumbling due to confusion in following Traffic Regulations unless
suitable steps are taken to decrease the number of vehicles. It is pertinent to
note that not only 50% of Tamil Nadu Rural Population migrated and settled in
Chennai, but also in Recent years Chennai became a ‘Hub’ to main Industries and
Technical Institutions and due to these reasons People all over India daily
come down to Tamil Nadu in search of work, Job, Business and thereafter, occupy
and settle here itself, now forming ‘Little India’. Thus daily we do witness
thick population on Roads, in Houses and in streets, causing congestions and
confusion State.
With regard to blowing of ‘Air Horn’
though it is banned by Madras High Court, the said conditions are not followed
and such neglecting acts are also neglected by Traffic authorities by not
insisting vehicle Air Horn users to implement the rules laid down. Under such
circumstances, having such a density of vehicles plying in congested roads,
with Air-Horn causing Horrible sound deafening the passerby, are used by almost
all vehicle owners as if it is their individual right, ultimately causing
annoyance, mental agony which causes Heart attack, and in endangering Health of
all people around, due to their carelessness Act in causing Noise and Air –
Pollution by disobeying Rules and Conditions, which are allowed continually.
It is to be noted that Air-Horn, is
completely banned in countries like Singapore, New York, since it causes
environment pollution resulting in Cardiac problem, with increasing number of
Heart Patients day by day with its nuisance and Havoc increasing on and on.
With regard to pedestrians, since lack
of equally pavement buildup area, in most of all areas along with Roads (in some
areas there is no pavement at all), pedestrians findings no other way but put
to risk by walking on Roads. It is also to noted even in main Roads, shop
owners extend their shops, keep vehicles in front of their shops and in Parsh
Bungalow areas, people are so selfish and ignoring rules, built their own
extended garden or make use of pavement area into a steep slop for their user
by for cars thus causing inconvenience to the pedestrians by compelling them to
walk in the middle of roads to meddle along with passerby vehicle to risk their
lives.
Under above said circumstances
Road-Accidents go on increasing and nearing 7 lakhs Traffic Violations cases
have been registered every year and twenty lakhs Traffic Violations act are
caused and side by side Traffic Accidents occurrences also are increasing more
and more day by day.
Inspite of all controls in all
vehicles, Hot air and increasing vapor causes AIR and Noise pollution
ultimately causing damages in Ozone layer. In India Motor Accidents on Road
occur in the range of one Accident per second. Numbers in count on purchasing
New cars also went up after 1995 Globalization of India.
In western countries/ European
countries, since Roads are laid as per rules and Traffic Rules are strictly
followed, People use their cycles to travel minimum stretch of 10 km Even car
owners use the cycles to prevent use of Petrol, Diesel in order to control pollution
as well as in support of Green House Revolution in order to promote Good Health
and Environmental friendly Acts. In our country this may be implemented /
encouraged by laying a separate track for cycle users.
Increasing number of Motor Vehicles
should be controlled in some way or by other methods in order to make People buy
and use Motor Vehicles only under necessary circumstances to serve the Real
purpose.
In Singapore the Government collects a
huge sum of Tax for any new purchase of Cars in order to control vehicle flow
and also for the Good Reason that only people who are really in need of
vehicles for useful purpose will buy and others avoid it.
In Mongolia one day Odd number cars are
allowed and next day car plates with Even numbers are allowed to ply on Roads.
Car owners are also permitted to board public on their way on payment of costs.
If such conditions are implemented in
our country there will be every possible of vehicle control and indirectly
economy will be saved, pollution will be under control and also there will be
decrease in Road/ Traffic Accidents. If Madras High Court Order on Ban of
Air-Horn is strictly followed, there will be no chaos and confusion due to Air
and Noise Pollution. To avoid parking on
Roads and on streets, Rules should be strictly followed and Road Parking
facilities are to be improved and developed in such a way to meet all the
necessities for which Rules must be framed. So that congestion will come to
Halt. Separate supervision authorities must be posted for the continuous
Supervision on maintaining smooth Roads without Patchment areas. Pedestrians’
Right to walk on pavement Area on Road sides should never be compromised for
anything or for any individual cause, which result in paving way to control
Road Accidents on Pedestrians.
Therefore survey and study must be
conducted and on seeking Report among experts suitable legislation may be
enacted in parliament and accordingly due Rules and Laws may be framed since it
is just and in necessity that centre – common Motor Vehicles Act should be
enacted and present Motor Vehicles Act to be amended accordingly, in order to
prevent all Pollution, congestion nuisances and all other illegal Acts and
irregularities on Road by strictly abiding the Amended Act and Rules to
maintain Public safety on day to day Order.
