 திமுக அமைச்சர் செந்தில் பாலாஜியை அமலாக்கத்துறை கைது செய்தது தொடர்பான வழக்கில் தாக்கல் செய்யப்பட்ட ஆட்கொணர்வு மனுவை அனுமதிக்க முடியாது என்று சென்னை உயர் நீதிமன்ற நீதிபதி சி.வி.கார்த்திகேயன் இன்று தீர்ப்பளித்திருக்கிறார்.

ஆரம்பத்தில் இருந்தே  அமைச்சரின் மனைவி ஆட்கொணர்வு மனுவைத் தாக்கல் செய்ய வேண்டிய அவசியம் என்ன? அது சட்டப்படி தவறு என்று யோசித்தேன். அந்த மனு நிராகரிக்கப்படும் என்று தொடர்ந்து கூறி வந்தேன். 

அன்று நான் கணித்தது இன்று நடந்து விட்டது. 

தங்கள் தலைவருக்கும், முதல்வருக்கும் சரியாக ஆலோசனை வழங்க முடியாத அரைவேக்காட்டு சட்ட ஆலோசகர்களுக்கு மத்தியில் திமுக இப்போது தலையைத் தொங்கப் போட்டு நிற்கிறது.   சுயநலம் கொண்ட உங்கள் அடியாட்கள் மற்றும்  கைக்கூலிகள் பேச்சுக்குச்  செவிசாய்த்தால் இதுதான் நடக்கும்.

2001-ல் ஆலிவர் சாலையில் உள்ள அவரது வீட்டில் திடீரென கைது செய்யப்பட்ட நமது அன்புத் தலைவர் கருணாநிதிக்காக கட்சியின் முக்கிய தலைவர்களான சண்முக சுந்தரம், ஆர்.எஸ்.பாரதி  ஆகியோருடன் நான் சேர்ந்து நாங்கள் 2001 செய்த  அரும்பெரும் முயற்சிகளை இப்போது நினைவு கூர்கிறேன்.  தேசிய மனித உரிமை ஆணையத்தையும், ,மாநில மனித உரிமை ஆணையத்தையும் நீதிமன்றங்களையும் அணுகி சட்டப்படி நடவடிக்கை எடுத்து வந்தோம். கட்சி மேலிடமும் சட்டரீதியான எங்கள் திட்டங்களுக்குத்  தலையாட்டியது.

ஆனால் அதிர்ஷ்ட வசமாக வாஜ்பாயி தலைமையிலான அன்றைய மத்திய அரசு கலைஞரை பெயில் இல்லாமல் விடுதலை செய்தது.

அதைப் போல இன்னொரு சமயத்தில் இன்றைய முதல்வர் ஸ்டாலினை அவரது வேளச்சேரி வீட்டில் போலீஸ் கைது செய்தது. அப்போது மாநில மனித உரிமைகள் ஆணையத்தை அணுகி வழக்கை நான் எடுத்துரைத்த பின்பு, ஸ்டாலின் கைது மனித உரிமை மீறல் என்று ஆணையம் ஆணையிட்டது. அவரை உடனடியாக விடுதலை செய்ய பரிந்துரைத்தது. இதற்கு ஸ்டாலின் துணைவியர் திருமதி துர்க்காவதி ஸ்டாலின்

அவர்களை மாநில மனித உரிமைகள் ஆணையத்துக்கம் அழைத்து சென்றேன்.

இதன் ஆவணங்கள் யாவும் எனது சமூக ஊடகங்களில் பதிவும் செய்துள்ளேன். அது மட்டுமல்ல ஜெயல்லிதா ஊழல் வழக்கை கர்நாடகத்துக்கு மாற்ற நானும், டெல்லி சம்பத்தும் முரசொலி மாறன் எங்களிடம் சொன்ன படி ஆற்றிய பணியை திமுக பொதுக்குழுவில் மாறன் பாராட்டி செய்திதாட்கள் செய்தி வந்ததும் உண்டு.இதற்கு சாட்சி அன்றைய சுகாதார  மத்திய ராஜாங்க அமைச்சர் ஆ.ராஜா, அவரின் செயலார் அகிலன் ராமநாதன்.இப்படி பல பணிகள் …

இப்படியெல்லாம் கட்சிக்காக புத்திசாலித்தனத்தோடும், சட்ட அறிவோடும் இயங்கியவர்கள் எல்லாம் ஒருகாலத்தில் திமுகவில் இருந்தார்கள். அவர்கள்  கட்சியால் மதிக்கப்பட்டு உயர்வாக மதிக்கப்பட்ட நாட்கள் அவை.

What I predicted has happened now

Now I stand vindicated.  Justice  C. V. Karthikeyan, judge of the Madras High Court, today ruled that the habeas corpus petition filed in the case involving the ED’s arrest of DMK minister Senthil Balaji cannot be allowed.

Right from the word go, I have been wondering at the need for the minister’s wife to file the HCP and saying bluntly that the petition would be rejected. It was legally not liable.

Today what I have predicted has happened. 

The DMK now has to stand crest-fallen amid its half-baked legal advisors who could not advise their leader and Chief Minister M K Stalin properly.  This is  what normally happens when you heed the advices of your minions,  sycophants and snobs who are selfish and self-centered at heart, paying just lip service to party ideology.

Now I recall with a sense of nostalgia how along with party stalwarts - Advocate General Shanmuga Sundaram and R. S. Bharathi – and I  moved the heaven and earth when our beloved leader M Karunanidhi was suddenly arrested in a pre-dawn crackdown at  his house on Oliver Road. I was very keenly taking our steps in letter and spirit of law, approaching the National Human Rights Commission, the State Human  Rights Commission and the courts during Kalignar’s and CM Stalin’s midnight arrests 2001.

Luckily our leader was released without bail thanks to the intervention of the then BJP government led by Vajpayee.

And later, on a different occasion when Stalin was arrested at his Velachery residence, I moved the State Human Rights Commission which passed strictures against the arrest which it termed as a violation of rights and took his  wife Thirumathi Durgawathi Stalin SHRC. Initiative task to transfer of corruption charges case against Jayalatha from Tamilnadu given to me and Delhi Sampath by Mursoli Maran.

Those were the days when a clean sanity and dynamism of functionaries prevailed over the half-baked ideas and when the party functionaries worth their salt were respected and held in high esteem. No more they are now in the present DMK.
