சென்னை உயர்நீதிமன்றம் மதுரை கிளையில் நான் தாக்கல் செய்திருந்த ரிட் மனு ( WP 4696 /2015) இன்றைக்கு (31-03-2015) விசாரணைக்கு வந்தது. உயர்நீதிமன்ற மதுரைக் கிளை இதுகுறித்து விளக்கம் கேட்டு, மாநில அரசுக்கு உரிய தாக்கீது நோட்டீசு அனுப்பியுள்ளது.
ஏற்கனவே இப்பிரச்சனை சம்பந்தமாக 1986ல், என்னுடைய ரிட் மனு சென்னை உயர்நீதிமன்றத்தில் தாக்கல் செய்து, அன்றைக்கு எம்.ஜி.ஆர் ஆட்சியில் தனியாருக்கு இந்த ஆலையை விற்க முடியாமல் தடுக்கப்பட்டது மட்டுமல்லாமல், சுற்றுச்சூழல் பாதுகாக்கப்பட்டு விவசாயமும் ஆலங்குளம் வட்டாரத்தில் பாதுகாக்கப்பட்டது என்பது பழைய செய்தி.

AFFIDAVIT
I, K.S.Radhakrishnan, Son of K.V.Srinivasa Naidu, Hindu, aged 59 years, residing at 4/359, Sri Chaitanya Avenue, Chennai-600 041, now temporarily come down to Madurai, do hereby solemnly sincerely affirm and state as follows:-
1. I am the petitioner herein and as such I am well acquainted with the facts of the case.
2. I also humbly submit that, I am originally native of Kurunjakulam village in Sankarankovil Taluk in Tirunelveli District, nearer to the border of Virudhunagar District, I am hailing from an agricultural family and and around my native village. The main source of income of public was agriculture. I am an advocate practicing in the Madras High Court. I am also spokesperson of D.M.K. I am also much interested in social activities and welfare activities of public at large. I also contested in the legislature assembly seat from Kovilpatti Legislature constituency. Therefore, I am interested in the public activities of this area, where my native places is situated.
3. I also humbly submit that, I am filing this writ petition as a Public Interest Litigation, for writ of mandamus. I have not received any remuneration or benefits from anybodyelse to file this petition as Public Interest Litigation. I am also an Income Tax Assessee and having Permanent Account Number. I am ready to obey this Hon’ble High Court’s order, if this Hon’ble Court finds that I am misusing the Hon’ble Court’s jurisdiction and impose any cost.
4. I also humbly submit that, when there was a move to establish a cement factory, by the Tamil Nadu Government, in Alankulam in Virudhunagar District, the agriculturist and general public, in and around the proposed place, Alankulam, affraiding the proposed construction of cement factory, would harm health and agriculture of the public, the then Government, pacified the public and their anguish, by giving undertaking that there would not be any such harms would accur there, because of the construction of the proposed cement factory. At last, with the support of the entire public a cement factory was constructed and installed at Alankulam.
5. I also humbly submit that, the then Tamil Nadu Government started, the erection of the cement factory and started the production of cement in 1970 itself. But since there was emition of smoke and dust, the public were scaring about the emition of air pollution and despite repeated request no action was taken. I filed a Public Interest Litigation in the Principle Seat of Madras High Court, as W.P.No. 10589/1986 for the redressal to make proper arrangements for the erection of effluent treatment plant, as per the standard prescribed and provisions of the air (Prevention and Control of Pollution) Act 1981, to treat the smoke emitted from the said cement factory. The Hon’ble High Court also passed an interim direction and finally passed an order, based on the report, filed by the Pollution Control Board Officers that the suggestion for controlling the pollution shall be properly carried out. With the above directions, the cement factory also obliged and carried out the directions and thereby satisfied the public at large. The public also were happy and the cement production also became high and the Tamil Nadu Government also benefited and the public are also benefited by getting jobs and also the production of cement factory, even as consumers.
6. I also humbly submit that, now, as the cement factory is running smoothly and getting profits and the public also consumed the products. But recently as a “bolt from blue” the Tamil Nadu Government and their officers, the respondents herein, are proposing to close the running of the cement factory and also are proposing to sell the factory and its properties, both immovable and movable and also acted in not updating in any updated technologies in the factory. Shocking to know the above news of closing of the cement factory, eventhough the entire public in this area are much agitated, some of the social activists and political and public leaders, moved with the Tamil Nadu Government to stop the proposal of closer of the cement factory. Hence, as I also one of the Environmental and social activist interested in the public welfare and obtained earlier directions from this Hon’ble Court, sent a petition on 12.02.2015, to these respondents, to stop the proposal and wanted to know the status and also to update the technology, in controlling the pollution of emition. The respondents also received the same petition. I also made personal representation before the respondents 1 and 2 repeatedly, before and after written petitions. But the respondents were not responding so far and turned deaf ear to my request and would not reply so far. Hence there is no other alternative to approach this Hon’ble Court once again for the reddressal.
7. I also humbly submit that, the above said circumstances, I left with no other alternative or efficacious remedy than, to file this Writ of Mandamus, under Article 226 of the Constitution of India. I have not filed any other Writ or litigation for this same redressal, before any other court of law.
8. Hence for the reasons stated above, it is prayed that this Hon'ble Court may be pleased TO DIRECT the respondents to update the technologies of Tamil Nadu Cement Factory (TANCEM) in Alankulam in Virudhunagar District, pending disposal of this Writ Petition and thus render justice.
9. Therefore, for the reasons stated above, it is prayed that this Hon'ble Court may be pleased to issue a WRIT OF MANDAMUS or any other order or direction, more in the form of WRIT, forbearing the respondents from closing or sale the same to private firms the TamilNadu Cement Factory (TANCEM), situated at Alankulam in Virudhunagar District, and pass such further or other orders, as this Hon’ble Court may deem fit and proper in the circumstances of this case and thus render justice.
